The following general contest rules apply to contests conducted by
KSWD(FM) The Sound (the "Station"). These rules (or any portion thereof)
may be modified or replaced by the Station at any time and are
subordinate to the specific rules for a particular contest. In the event of a
discrepancy between these rules and the specific rules for a particular
contest, the specific rules will apply.
Dates/Terms/Eligibility
Contests conducted by the Station are open to legal U.S. residents eighteen
(18) years of age or older at the time of entry residing in the State of
California. The Station may change the dates or terms of any contest,
including canceling the contest, without prior notice. Any material
changes will be broadcast on the Station or posted on a page at the
Station's website (the "Site") or both. There is no purchase necessary to
enter or win. A purchase will not improve a contestant's chances of
winning. Void where prohibited by law. Employees or agents of the
Station, Bonneville International Corporation, any entity associated with the
sponsorship or administration of the contest (collectively, the "Sponsors")
or any other radio or television station that transmits a signal for reception
anywhere within the State of California, as well as members of the same
household of the employee or agent, may not participate. Winners of any
contest or promotion conducted by the Station or Bonneville International
Corporation during the thirty (30) day period immediately prior to the start
of the contest may not participate. Limit one (1) entry per person and one
(1) winner per household.
Entry
For phone-in contests, the Station is not responsible for the failure or
inability to complete a telephone call, regardless of cause. Calling the
Station to participate in a contest constitutes permission for the Station to
tape the caller's voice or broadcast it over the air or both. All telephone
calls may be taped without further permission from the caller. For mail-in
contests, the Station is not responsible for lost, illegible, misdirected,
undelivered, mutilated or incomplete entry forms, regardless of cause. For
online contests, the Station is not responsible for technical, hardware,
software or telephone or other transmission failures of any kind; lost or
unavailable network connections or incomplete, garbled or delayed
computer transmissions, regardless of cause. For all contests, (a) the
Station reserves the right in its sole discretion to cancel or suspend the
contest should a virus, bug or other problem beyond the control of the
Station corrupt the administration, security or proper execution of the
contest, (b) no photocopied or mechanically reproduced entries will be
allowed, (c) entries must be received in hand by the deadline specified by
the Station for the contest, and (d) all entries become the sole and
exclusive property of the Station and will not be returned.
Prizes
The number of potential winners and the prizes that may be awarded will
be announced on a contest-by-contest basis. Odds of winning will vary
by contest. Each winner will be responsible for any taxes, fees, gratuities
or other charges that result from the receipt or use of their prize. Prizes
are not transferable or exchangeable and may not be substituted, except
at the discretion of the Station. As a condition of receiving their prize,
winners may be required to complete an IRS Form W-9 and may receive an
IRS From 1099-Misc.
Conditions/Restrictions
In exchange for the right to participate in a contest, each contestant
agrees to release and indemnify each of the Sponsors, and the officers,
directors, agents, parent companies, subsidiaries and employees of each of
the Sponsors, for, from and against any and all claims, demands or causes
of action of any nature or kind whatsoever, whether presently known or
unknown, foreseen or unforeseen, that arise out of the contestant's
participation in the contest. Entry into the contest constitutes permission
for each Sponsor and its designees to use the name, likeness, portrait,
voice and biographical material of each contestant for an unlimited period
of time in order to advertise, promote or publicize the Sponsor or the
products and services of any of its designees or both. Each prize winner
will be required to produce identification satisfactory to the Station and
sign an affidavit of eligibility and a release (including a publicity release) as
prepared by the Station. Anyone using fraudulent means to participate in
or win a contest will be subject to disqualification. EACH PRIZE WINNER
USES THEIR PRIZE AT THEIR OWN RISK. NOTHING IN THESE RULES MAY BE
CONSTRUED AS REQURING A PRIZE WINNER TO USE THEIR PRIZE OR ANY
COMPONENT OF THEIR PRIZE. THE DECISION TO USE A PRIZE OR ANY
COMPONENT OF A PRIZE RESTS SOLELY WITH THE PRIZE WINNER AND THE
PRIZE WINNER ASSUMES ALL RISK ASSOCIATED WITH THAT DECISION.
Payments of all federal, state and local taxes related to the award of a prize
in this sweepstakes are the sole responsibility of the winner of the prize. The
winner will be required to complete and submit an IRS form W-9 with the
winner's full social security number for receipt of any prize valued at $601 or
more for any prizes awarded by the station in a calendar year with an
aggregate value of $601 or more and such winnings will be reported to the
IRS. Failure to submit a complete W-9 or equivalent will result in forfeiture of
the prize.
